Welcome to TempoBurn! These Terms of Service ("Terms") govern your access to and use of the TempoBurn website, games, and related services (collectively, the "Services") provided by Red Shade Games LLC ("Red Shade Games," "we," "us," or "our"), a company based in the United States.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Use of the Services

The "Red Shade Games" name, "TempoBurn" name, and all related names, logos, product and service names, designs, and slogans are trademarks of Red Shade Games. You may not use such marks without our prior written permission.

Music and Song Content

Music, charts, and other song-related content in TempoBurn may be licensed from third parties or created by Red Shade Games. You may not copy, distribute, or create derivative works from any music or song content without proper authorization.

5. User Content

You may have the opportunity to submit content to the Services, including but not limited to messages, feedback, and suggestions ("User Content"). By submitting User Content, you grant Red Shade Games a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third party's rights.

6. Fitness and Health Disclaimer

By using TempoBurn, you acknowledge and agree that:

• Individual Results Vary: Any fitness or health results will vary based on individual effort, physical condition, and other factors. We make no guarantees of specific results.
• Not Medical Advice: Information about calories burned, activity levels, or fitness metrics is provided for entertainment and general informational purposes only and should not be relied upon for medical decisions.
• Pre-Existing Conditions: If you have any pre-existing medical conditions, including but not limited to heart conditions, respiratory issues, joint problems, or pregnancy, consult your doctor before using TempoBurn.
• Safe Environment: You are responsible for ensuring you have adequate space and a safe environment to play. Remove obstacles, ensure proper flooring, and maintain awareness of your surroundings.
• Hydration and Rest: Stay hydrated and take breaks as needed. Do not overexert yourself.
• Equipment Safety: If using any equipment (dance pads, controllers, etc.), ensure it is properly set up and in good condition.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. RED SHADE GAMES DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Red Shade Games does not warrant that:

• The Services will be uninterrupted, error-free, or completely secure;
• Any defects will be corrected;
• The Services will meet your expectations or requirements;
• Any health, fitness, or weight loss results will be achieved;
• Calorie or activity tracking features are medically accurate.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RED SHADE GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Services;
• Any conduct or content of any third party on the Services;
• Any content obtained from the Services;
• Unauthorized access, use, or alteration of your transmissions or content;
• Any injury, health issue, or physical harm arising from your use of the Services, including but not limited to injuries sustained while playing, cardiovascular events, or any other physical condition.

IN NO EVENT SHALL RED SHADE GAMES' TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Assumption of Risk

You expressly acknowledge and agree that your use of TempoBurn involves physical activity and inherent risks, including but not limited to:

• Physical injury from movement, falls, or collisions;
• Muscle strain, sprains, or other musculoskeletal injuries;
• Cardiovascular stress or events;
• Dehydration or heat-related illness;
• Aggravation of pre-existing conditions.

YOU VOLUNTARILY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, AND AGREE THAT RED SHADE GAMES SHALL NOT BE LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES ARISING FROM YOUR PARTICIPATION IN PHYSICAL ACTIVITY WHILE USING THE SERVICES.

10. Indemnification

You agree to indemnify, defend, and hold harmless Red Shade Games and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any legal proceeding, you agree to first contact us at legal@redshadegames.com and attempt to resolve the dispute informally for at least sixty (60) days.

Arbitration

If we cannot resolve the dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.

Class Action Waiver

YOU AND RED SHADE GAMES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
